WAIVER OF LIABILITY
I, acknowledge that I have authority, custody, and control for all members and registrants, and as such I individually, and on behalf of my child(ren), member(s) and registrants hereby accept any and all responsibility for, and assume the risk of any and all injury or damage to my person or such children, registrants, members or wards which might arise directly or indirectly as a result of, in any way related to my participation in a West Shore Indian Princess & Indian Guide program. I hearby expressly waive all claims and damages, including actual and/or punitive damages or loss to my persons or property and that of my children, registrants, members, or wards that may be caused by an act or failure to act of the directors, officers, agents, members and volunteers in their capacities as representatives of the West Shore Indian Princesses and Indian Guides organization. I certify that I am familiar with the contents of this release, that I have read and understand the same, and that it is my intention by signing this release that the same be binding not only me, my children, registrants, members and wards, but also my heirs, administrators, executors, successors, and assigns and further waive all rights of subrogation.
COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. The West Shore Indian Princesses and Indian Guides (WSIPIG) cannot guarantee that you, your child(ren), your spouse, or anyone else will not become exposed to or infected with COVID-19 or its variants as a result of participating in any WSIPIG program, event or activity. Participation in any WSIPIG program, event, or activity could increase the risk of contracting COVID-19 or other conditions, diseases, viruses or injuries.
In consideration of being permitted to participate in programs, events and/or activities offered by WSIPIG, I understand, acknowledge and agree to the following:
I have independently evaluated and reviewed the risks of being exposed to or infected with COVID-19 or other conditions, diseases, viruses or injuries and have determined to participate in WSIPIG programs, events, and/or activities with full knowledge and acceptance of the risk. Fully understanding these risks, I, for myself, my child(ren), my spouse, my legal representatives, heirs, and assigns, hereby agree to assume full responsibility and liability for the risk of bodily injury, personal injury, illness, permanent disability, and/or death which may result from exposure to or infection with COVID- 19 or other conditions, diseases, viruses or injuries before, during, or after participating in a program, event, or activity.
I, for myself, my child(ren), registrants, members, wards, my spouse, my legal representatives, heirs and assigns, hereby waive, release, and discharge WSIPIG, its officials, volunteers, attorneys, and agents and representatives from any and all liability to me, my child(ren), registrants, members, wards, my spouse, my legal representatives, heirs, and assigns, for any and all losses or damages resulting from bodily injury, personal injury, illness, permanent disability, and/or death, whether caused by negligence of WSIPIG or its officials, volunteers, attorneys, and agents and representatives or otherwise, which claims, losses, and demands arise during or result directly or indirectly from exposure to or infection with COVID-19 or other conditions, diseases, viruses or injuries before, during, or after participating in a WSIPIG program, event, or activity and further waive any and all rights of subrogation relative to same.
I also acknowledge that in the event the State or local health department issues a mandatory or advisory “Stay at Home” order, or mandates or recommends the closure of certain programs and/or facilities or other factors arise outside the control of WSIPIG, WSIPIG will endeavor to credit activity and/or registration fees, but refunds will be at the discretion of the WSIPIG and all claims related to same are hereby waived and that I shall comply with any applicable health guidelines, mandates or orders then in effect.
AUTHORIZATION TO TAKE AND USE PHOTOGRAPHS/VIDEO AND WAIVER AND RELEASE OF CLAIMS
I, individually, and on behalf of my child(ren), registrants, wards, member(s) hereby grant to the West Shore Indian Princesses and Guides, its directors, officers, agents, members, and volunteers and their respective designees (collectively “WSIP”) the non-revocable permission to capture our images and likenesses in photographs, video, recordings, and other media or that I may share such with WSIP (collectively “Images”). I acknowledge that WSIP shall own such Images and further grant to WSIP to copyright, display, use, publish, distribute, modify, print, and reprint such Images in any manner whatsoever related to WSIP. All rights to inspect or approve use of such Images is hereby waived. WSIP is hereby released and held harmless from any and all liability related to the Images and their use including but not limited to claims for invasion of rights of privacy or publicity.
CONDITION of MEMBERSHIP
Membership in the Westshore Indian Princesses and Indian Guides (“WSIP”) program is a privilege. Successful membership and a successful organization require consistent efforts in preserving and maintaining the integrity of our programs. Specific WSIP membership conditions and requirements are set forth in the By-Laws of the organization on this website. By registering for membership in the WSIP, you are specifically agreeing to be bound by all conditions and requirements of membership. Failure to comply may result in rejection and/or termination of membership.
Recently, the WSIP’s insurance carrier instituted an additional membership requirement that all members be screened for a determination of whether or not they are on the applicable sex offender registry. WSIP does not handle this review directly, and it is handled by a third party vendor selected by WSIP’s insurance carrier. This is for the benefit of all involved in the organization and successful completion of this step in the registration process is an absolute requirement for membership in the WSIP. WSIP makes no representations or warranties as to the accuracy of this review and by registering, you agree to release and hold WSIP harmless from any liability related to such evaluation.
EVENT REFUND POLICY
WSIPIG will endeavor to credit activity and/or registration fees, but refunds will be at the discretion of the WSIPIG and all claims related to same are hereby waived. In general, if we can avoid costs by knowing ahead of time that you can't make an activity you registered and paid for, we will provide a full refund.
